General Terms

These Terms of Service ("Terms") govern your access to and use of the services, websites, and applications offered by Your Forms ("Service"). By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy.

Limitation of Liability

Your Forms shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; (c) any content obtained from the Service; and (d) unauthorized access, use or alteration of your transmissions or content.

Governing Law

These Terms and any action related thereto will be governed by the laws of Wyoming without regard to or application of its conflict of law provisions or your state or country of residence.

Changes to the Terms

We reserve the right to modify or replace these Terms at any time, at our sole discretion. We will make reasonable efforts to provide notice of any changes. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

Eligibility

To access or use the Service, you must be at least 13 years of age or older. If you are between 13 and 18 years of age (or the age of legal majority in your jurisdiction), you can use the Service only under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

User Responsibility

As a user of Your Forms, you are responsible for ensuring that your use of the Service complies with all laws, rules, and regulations applicable to you. You also agree to the following:

  • Account Security: You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password.
  • Accurate Information: You agree to provide accurate, current, and complete information about yourself as may be prompted by any registration forms on the Service. You further agree to maintain and promptly update your personal information to keep it accurate, current, and complete.
  • Lawful Use: You agree not to use the Service for any unlawful purpose or in any way that interrupts, damages, impairs, or renders the Service less efficient.
  • Respectful Conduct: You agree not to attempt to harm our Service or network, or, interfere with, or disrupt other users, network services, or network equipment. Disruptions include, but are not limited to, distribution of unsolicited advertising or chain letters, propagation of computer worms and viruses, and using the network to make unauthorized entry to any other machine accessible via the network.
  • Content Responsibility: You are solely responsible for the content that you upload, publish, display, link to, or otherwise make available (hereinafter, "post") on the Service, and you agree that we are only acting as a passive conduit for your online distribution and publication of your content.

We reserve the right to terminate your access to the Service if you fail to comply with these responsibilities.

Intellectual Property Rights

All intellectual property rights in and to the Service, including but not limited to design, structure, images, photographs, sound, video, documents, data, text, and other materials contained therein, are owned by or licensed to Your Forms. Except as expressly authorized by Your Forms, you may not use, alter, copy, distribute, transmit, or derive another work from any materials obtained from the Service or the Website, except as expressly permitted by the Terms.

Copyright Infringement Notice Procedure

Your Forms respects the intellectual property rights of others and expects its users to do the same. It is our policy to respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA) and other applicable intellectual property laws.

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please provide our Copyright Agent the following information:

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material.
  • Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an electronic mail address.
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Indemnification

You agree to indemnify, defend, and hold harmless Your Forms, its officers, directors, employees, agents, licensors, suppliers, and any third-party information providers to the Service from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of these Terms of Service or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the Service using your account.

This indemnification obligation will survive the termination of these Terms of Service and your use of the Service. Your Forms reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with Your Forms in asserting any available defenses.

Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

Waiver

The failure of Your Forms to enforce any right or provision in these Terms will not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing.

Maximum Liability

In no event shall Your Forms be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of or in any way connected with the use of this Service or with the delay or inability to use this Service.

Refunds

Your Forms is committed to customer satisfaction. If you are not satisfied with your purchase, you may be eligible for a refund subject to the following conditions:

  • Eligibility: Refunds are only available for purchases made directly through Your Forms. If you purchased a Your Forms product or service through a third party, please contact them directly for refund requests.
  • Time Frame: Refund requests must be submitted within 30 days of purchase. Refund requests beyond this time frame may not be eligible.
  • Condition of Product or Service: For products, they must be returned in their original condition, unused, and with all original packaging and accessories. For services, refunds will be considered based on the service usage and completion status.
  • Processing: Once your refund request is received and inspected, we will send you an email to notify you of the approval or rejection of your refund. If approved, your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.
  • Partial Refunds: In certain cases, only partial refunds may be granted. This includes instances where the product is not in its original condition, is damaged or missing parts for reasons not due to our error, or if the refund request is made after the specified time frame.
  • Exchanges: We only replace items if they are defective or damaged. If you need to exchange it for the same item, contact our customer service.

Dispute Resolution Process

Informal Resolution

Before filing a claim against Your Forms, you agree to try to resolve the dispute informally by contacting ash@yourforms.io. We will try to resolve the dispute informally by contacting you via email. If a dispute is not resolved within 30 days of submission, you or Your Forms may bring a formal proceeding.

Binding Mediation & Arbitration

Any dispute or claim relating in any way to your use of the Service will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

Exceptions to Agreement to Arbitrate

Either you or Your Forms may assert claims, if they qualify, in small claims court in Wyoming. Furthermore, either party may seek injunctive relief in any court of competent jurisdiction to prevent the actual or imminent infringement, misappropriation, or violation of a party’s copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between us and you individually. To the full extent permissible by law, (a) no arbitration or proceeding shall be joined with any other; (b) there is no right or authority for any dispute to be arbitrated or resolved on a class-action basis or to utilize class action procedures; and (c) there is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.

Limitations on Promotions or Offers

Promotions, discounts, and special offers are subject to limitations and may be discontinued at Your Forms's discretion without notice. Unless otherwise stated, promotions and offers are non-transferable, cannot be exchanged for cash or other alternatives, and may have specific eligibility requirements. The terms and validity period of each promotion or offer will be specified at the time of issue.

Miscellaneous

These Terms of Service constitute the entire agreement between you and Your Forms regarding the use of the Service. The failure of Your Forms to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision. These Terms operate to the fullest extent permissible by law.

Typographical Errors

In the event that a Your Forms product or service is mistakenly listed at an incorrect price or with incorrect specifications, Your Forms reserves the right to refuse or cancel any orders placed for the product or service listed incorrectly. Your Forms reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged.

Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and Your Forms and govern your use of the Service, superseding any prior agreements between you and Your Forms (including, but not limited to, any prior versions of the Terms).
